Terms and Conditions for Services at Gym 72 Limited
- Agreement to Terms:
By engaging in the services provided by Gym 72, you acknowledge and agree to be bound by these terms and conditions. These terms constitute a legally binding agreement between you (referred to as “Client” or “You”) and Gym 72 (referred to as “We,” “Us,” or “Our”). Please read these terms carefully before commencing our services.
- Scope of Services:
a. Personal Training Sessions: We will provide personalised fitness training sessions tailored to your specific needs and goals. These sessions may include exercises, workouts, nutritional guidance, and other fitness-related activities.
b. Fitness Assessments: We may conduct initial and periodic fitness assessments to evaluate your physical condition, measure progress, and adjust training programs accordingly.
c. Additional Services: We may offer additional services, such as nutrition counselling, exercise programming, or online support, which will be subject to separate terms and fees.
D. Massage Therapy: Part of your treatment will involve an initial consultation to determine how we treat you to best suit your needs.
- Client Responsibilities:
a. Health and Medical Clearance: You must ensure that you are in good physical condition and have no medical conditions that would prevent you from engaging in physical exercise. It is your responsibility to obtain a medical clearance from a qualified healthcare professional if necessary.
b. Honest Disclosure: You must provide accurate and complete information about your health history, medications, injuries, and any other relevant factors that may affect your participation in the training sessions.
c. Compliance with Instructions: You agree to follow the instructions and guidance provided by the personal trainer during the training sessions, including safety guidelines and proper technique.
d. Communication: You must promptly inform the personal trainer of any discomfort, pain, or concerns that arise during or after the training sessions.
- Payment and Cancellation:
a. Fees: You agree to pay the agreed-upon fees for personal training services as specified by Gym 72. Payment terms, including rates, billing cycles, and accepted payment methods, will be communicated to you prior to commencing services.
b. Cancellation Policy: If you need to cancel or reschedule a training session, you must provide Gym 72 with 24 hours notice. Failure to provide adequate notice may result in the session being charged in full.
c. Refunds: We do not offer refunds on services, unless we are no longer able to provide the service purchased. Block booking payments are to be used within a 12 month period after first date of purchase. There is a minimum term of 3 months training for direct debit payment options. Sessions can be transferred over to another person at the discretion of Gym 72.
- Liability and Waiver:
a. Assumption of Risk: You acknowledge that engaging in physical exercise carries inherent risks and hazards. You voluntarily assume all risks associated with participation in the personal training sessions and release [Company Name] and its trainers from any liability for injuries, losses, or damages incurred during or after the sessions.
b. Indemnification: You agree to indemnify and hold Gym 72, its trainers, and representatives harmless from any claims, demands, damages, or losses arising out of or in connection with your participation in the personal training services.
c. Personal Property: Gym 72 shall not be liable for any loss, damage, or theft of personal belongings that occur on the premises or during training sessions.
- Confidentiality:
Any personal or health-related information shared between you and Gym 72 will be treated as confidential and will not be disclosed to third parties without your explicit consent, except where required by law.
- Termination:
Either party may terminate the personal training services with reasonable notice as highlighted above (4c). In case of termination, any prepaid but unused sessions may be refunded according to Gym 72’s refund policy.
- Governing Law and Jurisdiction:
These terms and conditions shall be governed by and construed in accordance with current United Kingdom laws. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts.
